This Application collects some Personal Data from its Users. In this Privacy Policy, we will explain what data Dock Health (the "Application") collects, how it is transported over the Internet and how it can or cannot be linked to individual users.

Users understand that by using the Application, they are choosing to provide their Personal Data, and the Personal Data of their patients, family members, to the Application.

Protected Health Information

Some of the information we collect in connection with the Service may be “Protected Health Information” (as that term is defined at 45 C.F.R. § 150.613) protected under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) and Subtitle D of the Health Information Technology for Economic and Clinical Health Act (the “HITECH Act”). We will use, protect and disclose any Protected Health Information (“PHI”) in accordance with our Notice of Privacy Practices, as mandated by HIPAA, available here. To the extent that there is any inconsistency between this Privacy Policy and the Notices of Privacy Practices, the Notice of Privacy Practices will prevail.

Patient data with protected health information will also be collected and utilized through the application, either by manual entry or through connectivity via an electronic health record (EHR). Such data will include demographics including, patient name, date of birth, medical record number, gender, and contact information. In addition, tasks generated on behalf of the patient through use of the application will be saved to the record of that specific patient on the Application (not in the EHR) .

Inviting an user to an “Organzation” or "List” (Dock) will give that user access to the PHI contained within that Organization and/or List. Only the Owner of a List can invite and therefore give access to new members to a List or Administrators of a List, as designated by the Owner of that List. Owners (and its Administrators by proxy) of a List and the PHI contained therein are solely responsible for appropriate sharing of access to the List and the protected information contained within the List. Invitations to join an Organization will similarly allow access to the PHI contained therein and should only be shared with trusted individuals. The Company does not take any responsibility for any willful or unintended sharing of this information (PHI) by inviting access to a List to an unitended or intended party.

Types of Data collected

As a registered user of the Application, among the types of Personal Data that this Application collects that are collected, by itself or through third parties, there are: Cookies, Usage Data, email, phone number, gender, date of birth, credentials, Contacts permission, Camera permission, push notification permission, SMS permission, and Reminders permission.

Other Personal Data collected may be described in other sections of this privacy policy or by dedicated explanation text contextually with the Data collection.
The Personal Data may be freely provided by the User, or collected automatically when using this Application.


Any use of Cookies - or of other tracking tools - by this Application or by the owners of third party services used by this Application, unless stated otherwise, serves to identify Users and remember their preferences, for the sole purpose of providing the service required by the User.


Failure to provide certain Personal Data may make it impossible for this Application to provide its services.

Users are responsible for any Personal Data of third parties obtained, published or shared through this Application and confirm that they have the third party's consent to provide the Data to the Owner.

Children under 18 years of age are not allowed to register for or use the Application. We do not knowingly allow anyone under 18 to register for the Application on their own. If we learn that we have collected Personal Information from a person under age 18, we will delete that information.

How Do We Use the Information We Collect?

Personal Information

: We will use and store Personal Information for the purpose of delivering the Service to you, and to enhance and analyze the operation of the Service. We may also use Personal Information for the internal operational and administrative purposes of the Service.

Aggregate Information

: We will also use customer information to create aggregated data for analytical purposes. This statistical information does not contain any Personal Information, details of a task or PHI and is used to understand our customer base and to better serve our market.

Tracking Information

: We use Tracking Information to administer the Service and to understand how well our Service is working, to store your user preferences and customize the Service for you, and to develop aggregate, statistical information on usage of the Services. This allows us to determine which features visitors like best to help us improve our Service, to personalize your user experience, and to measure overall effectiveness.

Legal Exception

: Notwithstanding the above, we may in any event use Personal Information and other information collected through the Service to the extent required by law or legal process, to resolve disputes, to enforce our agreements (including this Privacy Policy and the Terms of Service) with you, or if in our reasonable discretion use is necessary to protect our legal rights or to protect third parties.

Email Communications

: If you create an account and provide your email address, we will send you administrative emails (i.e. updates on a task, users in your list, invitations to new lists, etc.). All users receive administrative emails, and so you cannot opt out of them while you remain an account holder.

Protection of Personal Data

All information collected through the Application is encrypted and stored locally on your device in transit and at rest in HIPAA-compliant databases. Additionally, you will set an access passcode for the Application upon first signing up within the Application. While Personal Data and health information you provide is encrypted and stored on the device and in the cloud, be aware that by your use of third party data backup or cloud storage services, like the iCloud backup service provided by Apple, Inc., you may be sharing the Application’s data with others.

Access to the Application on your device is protected by the passcode you selected after you registered for the Application. This passcode needs to be entered every time you access the Application. You should take steps to prevent unauthorized access to your account and personal information by selecting and protecting your passcode appropriately and limiting access to your smartphone. We strongly recommend and in many institutions it is required to have a password-protected mobile device. In order for the Application to be HIPAA compliant, your mobile device should have password protection.

We endeavor to protect the privacy of the Personal Information we hold in our records, but we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of your Personal Information at any time.

You should only use or transmit data from the Application if you are in the United States. You should be aware that the laws in the United States may not protect your privacy to the same extent as the laws in the country from which you have used or transmitted data to the Application.

Mode and place of processing the Data

Methods of processing

The Application processes the Data of Users in a proper manner and shall take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data.


The Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Application, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of the site (administration, sales, marketing, legal, system administration) or external parties (such as third party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Owner. The updated list of these parties may be requested from the Application at any time.

Place

The Data is processed at the Application's operating offices and in any other places where the parties involved with the processing are located. For further information, please contact the Owner.

Retention time

The Data is kept for the time necessary to provide the service requested by the User, or stated by the purposes outlined in this document, and the User can always request that the Application suspend or remove the data.

The use of the collected Data

The Data concerning the User is collected to allow the Owner to provide its services, as well as for the following purposes: Analytics, Handling activity data and Device permissions for Personal Data access.

The Personal Data used for each purpose is outlined in the specific sections of this document.

Device permissions for Personal Data access

This Application requests certain permissions from Users that allow it to access the User's device Data as described below.

By default, these permissions must be granted by the User before the respective information can be accessed. Once the permission has been given, it can be revoked by the User at any time. In order to revoke these permissions, Users may refer to the device settings or contact the Owner for support at the contact details provided in the present document.


The exact procedure for controlling Application permissions may be dependent on the User's device and software.

Please note that the revoking of such permissions might impact the proper functioning of this Application.

If User grants any of the permissions listed below, the respective Personal Data may be processed (i.e accessed to, modified or removed) by this Application.

Push Notifications

Push notifications are messages that are sent to your smartphone to remind you or prompt actions initiated by the Application. The Application may send you push notifications now and in the future. You can choose to disable notifications in settings.

Calendar permission

Used for accessing the calendar on the User's device, including the reading, adding and removing of entries.

Camera permission

Used for accessing the camera or capturing images and video from the device.

Contacts permission

Used for accessing contacts and profiles on the User's device, including the changing of entries.

Reminders permission

Used for accessing the Reminders Application on the User's device, including the reading, adding and removing of entries.

SMS permission

Used for accessing features related to the User's messaging including the sending, receiving and reading of SMS.

Storage permission

Used for accessing shared external storage, including the reading and adding of any items.

Detailed information on the processing of Personal Data

Personal Data is collected for the following purposes and using the following services:

  1. Analytics. The services contained in this section enable the Owner to monitor and and analyze web traffic and can be used to keep track of of User behaviorinteractions with the application. The Application uses Amazon Web Services Mobile Analytics (Amazon Web Services, Inc.), although the provider of this service may change at any time. AWS Mobile Analytics is a web mobile usage analysis service provided by Amazon Web Services, Inc. (“AWS”). It is utilized to . AWS utilizes the Data collected to track and examine the use of this Application, to prepare reports that will help on improve user workflows and experience with the Applicationits . activities and share them with other AWS services.

  2. Device permissions for Personal Data access. This Application requests certain permissions from Users that allow it to access the User's device Data as summarized here and described within this document. Personal Data collected: Calendar permission, Camera permission, Contacts permission, Reminders permission, Sensors permission, SMS permission and Storage permission.

  3. Personal Data Collected. This Application requests certain permissions from Users that allow it to access the User's device Data as summarized here and described within this document. Personal Data collected may include but is not limited to: name, email, phone number, gender, and credentials and schedule.

Additional information about Data collection and processing

Legal action

The Owner will cooperate with government and law enforcement officials and comply with the law. Therefore, Tthe User's Personal Data may be used for legal purposes by the Application, in Court or in the stages leading to possible legal action arising from improper use of this Application or the related services.


The User declares to be aware that the Application may be required to reveal personal data upon request of public authorities.

Additional information about User's Personal Data

In addition to the information contained in this privacy policy, this Application may provide the User with additional and contextual information concerning particular services or the collection and processing of Personal Data upon request.

System logs and maintenance

For operation and maintenance purposes, this Application and any third-party services may collect files that record interaction with this Application (System logs) or use for this purpose other Personal Data (such as IP Address).

The rights of Users

Users have the right, at any time, to know whether their Personal Data has been stored and can consult the Application to learn about their contents and origin, to verify their accuracy or to ask for them to be supplemented, cancelled, updated or corrected, or for their transformation into anonymous format or to block any data held in violation of the law, as well as to oppose their treatment for any and all legitimate reasons. This Application does not support “Do Not Track” requests. To determine whether any of the third-party services it uses honor the “Do Not Track” requests, please read their privacy policies.

Changes to this privacy policy

The Application reserves the right to make changes to this privacy policy at any time by giving notice to its Users on this page. It is strongly recommended to check this page often, referring to the date of the last modification listed at the bottom. If a User objects to any of the changes to the Policy, the User must cease using this Application and can request that the Application remove the Personal Data. Unless stated otherwise, the then-current privacy policy applies to all Personal Data the Application has about Users.

Definitions

Personal Data (or Data)

Any information regarding a natural person, a legal person, an institution or an association, which is, or can be, identified, even indirectly, by reference to any other information, including a personal identification number.

Usage Data

Information collected automatically from this Application (or third party services employed in this Application), which can include: the IP addresses or domain names of the computers utilized by the Users who use this Application, the URI addresses (Uniform Resource Identifier), the time of the request, the method utilized to submit the request to the server, the size of the file received in response, the numerical code indicating the status of the server's answer (successful outcome, error, etc.), the country of origin, the features of the browser and the operating system utilized by the User, the various time details per visit (e.g., the time spent on each page within the Application) and the details about the path followed within the Application with special reference to the sequence of pages visited, and other parameters about the device operating system and/or the User's IT environment.

User

The individual using this Application, which must coincide with or be authorized by the Data Subject, to whom the Personal Data refers.

Data Subject

The legal or natural person to whom the Personal Data refers.

Data Processor (or Data Supervisor)

The natural person, legal person, public administration or any other body, association or organization authorized by the Application to process the Personal Data in compliance with this privacy policy.
